Montgomery Advertiser’s 2008 Checkered Flag Challenge Contest
OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, the Montgomery Advertiser’s 2008 Checkered Flag Challenge Contest (the “Contest”) is open to U.S. residents (excluding Puerto Rico) who are 13 years or older at the time of entry. Employees of the Montgomery Advertiser, The Advertiser Company, Gannett Co., Inc., or UPICKEM and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win.
3. How To Enter. The Contest will begin at 12:01 a.m. (Central Time) on February 24, 2008 and end at 11:59 p.m. (Central Time) on November 16, 2008 (the “Contest” Period”).
Enter by visiting www.montgomeryadvertiser.com/CheckeredFlagChallenge official registration page and completing all of the required information and following all posted instructions. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Complete the entry form and any other required fields and then submit your entry by clicking on the “SEND” button. By entering, you agree to the terms of these Official Rules and to receive e-mails from Sponsor or those directed by Sponsor. You can opt-out of the receipt of such e-mails by following the directions on the Contest website or in any email received from Sponsor.
Sponsors will not be responsible for incomplete, lost, late, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsors. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsors in their sole discretion, and Sponsors reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. This contest is not intended for gambling. If it is determined that an entrant is using the contest for gambling purposes or in violation of any applicable law or regulation, they will be disqualified and reported to authorities.
4. Prizes and Odds. One (1) weekly prize of $50.00 will be awarded each week that there is a qualifying automobile race, beginning with the race on February 24, 2008 through November 18, 2008. One (1) grand prize of $500.00 will be awarded at the end of the Contest. Each winner is picked based on a points system described below under Winner Selection. Odds of winning depend on the number of eligible entries received. Only one weekly prize per person. Weekly winners are eligible for the Grand Prize.
5. Winner Selection. For each weekly race entrants will pick the 10 drivers they think will finish 1st through 10th. Fantasy Points will be awarded based on how the place the driver finished. 1st place is worth 150, 2nd place is worth 125, 3rd place is worth 100, 4th place is worth 80, 5th place is worth 78, and so on up to the 45th place (less 2 points each place). 44th place – last place are worth 0 points. The total Fantasy Points for all the entrant’s drivers in the race becomes the entrant’s Team Score. There is an additional 25 point bonus for every driver that finishes in the exact order the entrant picks them to finish.
Weekly Winners are selected based on total Fantasy Points earned calculated on the race finish order immediately following the race. If the race finish order is adjusted after the race, the weekly winners will remain the same but the entrants’ points will be recomputed for determining the Grand Prize Winner. Grand Prize Winner will be the entrant with the highest total of Fantasy Points for the 15 races over the Contest period.
If there is a tie for a Weekly Winner the first tie breaker is based on which entrant picked the highest number of drivers finishing in the right order. If needed, the second tie breaker will be based on which of the tied entrants picked the highest placement of drivers correctly. If a third tie breaker is needed, the winner will be randomly selected from all remaining tied entries. If there is a tie for the Grand Prize, the entrant with the most race points for the most recent race will be the winner. If a second tie breaker is needed, the winner be selected based on the Fantasy Points for the previous races will be used, until a winner is selected. If there is still a tie, the winner will be randomly selected from the remaining tied entries. Fantasy Points are awarded to drivers, not cars. If an entrant picks a driver who qualified for a race and a new driver took his/her place before the start of the race, the entrant must pick the new driver in order to be awarded points. Entrants will not receive Fantasy Points even though the new driver may be racing the previous driver’s car. If the new driver is not in the list of drivers that can be picked then no entrants shall have the ability to pick that driver and no fantasy points will be awarded. All decisions of the Sponsor are final. All winner results posted on the Sponsor’s website are unofficial until winners respond to email notification and winner is verified by Sponsor.
6. Winner Notification and Acceptance. Weekly Winners will be notified on or about the day following the race for that particular week at the email address provided on winner’s entry form. If a winner is unreachable after seven (7) days, or if that winner is deemed ineligible, an alternate winner will be selected. To claim a weekly prize, each Weekly Winner must contact Derek Lambert at (334) 240-9260 and then personally visit Sponsor’s offices: The Montgomery Advertiser, 425 Molton Street, Montgomery, Al within five (5) business days after notification (office visits must be between the hours of 8 a.m. and 5 p.m. weekdays) and a valid photo identification may be required. The Grand Prize Winner will be notified in the same manner as each Weekly Winner. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Prizes won by minors will be awarded to parent or legal guardian who must sign any affidavit or release required by Sponsors. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication by Sponsor of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsors. 7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserve the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
8. Copyright and Release. The Contest and all of the related pages, content and code are copyrighted by UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks, or any other intellectual property without the express written consent of UPICKEM or Sponsor, as applicable, is strictly prohibited. Each entrant and each winner, by acceptance of the prize, agrees to release Sponsor, UPICKEM, and their parent and subsidiary companies, their officers, directors, employees, agents, affiliates, from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. Sponsor. The Montgomery Advertiser’s 2008 Checkered Flag Challenge Contest is sponsored by the Montgomery Advertiser. The decisions of Sponsor regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
